The Conservatives are rushing to implement an American law that threatens the rights of more than a million Canadians.

The intergovernmental agreement to implement the U.S. Foreign Account Tax Compliance Act (FATCA) mandates Canada to supply the U.S. government with sensitive financial information on Canadians who also hold U.S. citizenship.

More than a million Canadians with dual citizenship could be caught up in this net.

The Conservatives' plan is buried in their 359-page omnibus budget bill. Now they are rushing it through Parliament—without the safeguards needed to protect our constitutional and privacy rights.

We, the undersigned residents of Canada, recognize the following: 

  • The Foreign Account Tax Compliance Act (FATCA) unfairly targets many ‘accidental Americans’ and dual citizens living in Canada.
  • The Government of Canada has an obligation to uphold privacy protections and constitutional rights under in Canadian law.
  • Concerns have been raised that the Intergovernmental Agreement (IGA) for the implementation of FATCA in Canada may violate the privacy rights of Canadians and may be subject to constitutional challenge.

THEREFORE we call on the Government of Canada to reconsider its attempt to implement FATCA in Canada and work to ensure that privacy rights of all Canadians are protected.
